Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Ilmora application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including users who create accounts, use free features, or purchase Premium subscriptions.

2. Description of Service

Ilmora is an Islamic prayer companion application that provides:

• Prayer time calculation and tracking
• Quran reader with audio playback and translations
• Dhikr (remembrance) counter
• Fasting tracker (Ramadan and voluntary fasts)
• Islamic calendar and event reminders
• Zakat calculator
• Qibla direction finder
• Halal food finder and mosque locator
• Prayer Buddy social feature
• Premium subscription with additional features

The App is available for iOS devices running iOS 16 or later.

3. User Accounts

3.1 Account Creation

You may use the App as a guest or create an account using Sign in with Apple, Google Sign-In, or email and password. You must provide accurate information when creating an account.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

3.3 Account Termination

You may delete your account at any time from the App (Settings → Delete Account, under the Storage section). Account deletion is permanent and irreversible. All associated data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Premium Subscription

4.1 Subscription Plans

Ilmora offers a Premium subscription available as:

• Monthly plan — billed monthly
• Annual plan — billed annually

Current pricing is displayed in the App and in the App Store listing. Prices may vary by region and are subject to change.

4.2 Billing

Premium subscriptions are billed through your Apple App Store account. Payment is charged to your Apple ID account at confirmation of purchase.

Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscription and turn off auto-renew in your Apple ID Account Settings at any time.

4.3 Refunds

All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies. Refund requests must be submitted directly to Apple.

4.4 Free Trial

The annual plan includes a 7-day free trial for new subscribers. The trial begins on the date of subscription initiation. Any unused portion of the free trial period is forfeited when the subscription is purchased. The monthly plan does not include a free trial.

4.5 Changes to Premium Features

We reserve the right to modify, add, or remove Premium features. We will make reasonable efforts to notify you of material changes that reduce the value of your existing subscription.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any unlawful purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Interfere with or disrupt the integrity or performance of the App
• Transmit any harmful, offensive, or abusive content through any App feature
• Attempt to reverse-engineer, decompile, or disassemble any part of the App
• Use automated means (bots, scrapers) to access or interact with the App
• Impersonate another person or misrepresent your identity or affiliation
• Use the Prayer Buddy feature to harass or harm other users

6. Prayer Buddy Feature

The Prayer Buddy feature is an optional social feature that allows you to connect with another user and share prayer completion status. By using this feature:

• You consent to your prayer completion data being shared with your connected buddy
• You may control whether your name is visible to your buddy (Settings → Privacy)
• You can remove a buddy or block a user at any time
• You must not use this feature to harass, stalk, or intimidate others
• We reserve the right to suspend Prayer Buddy access for users who abuse it

7. User-Generated Content

7.1 Your Content

The App allows you to create personal notes, annotations, and feedback (collectively "Your Content"). You retain ownership of Your Content.

By submitting feedback (mosque or halal reports), you grant us a non-exclusive, royalty-free license to use that feedback to improve the App and its data.

7.2 Content Standards

Any content you submit through the App (such as feedback or reports) must not:

• Be false, misleading, or defamatory
• Contain hate speech, threats, or harassment
• Infringe upon the intellectual property rights of others
• Violate any applicable laws or regulations

We reserve the right to remove any content that violates these standards.

8. Intellectual Property

8.1 Our Rights

The App, including its code, design, text, graphics, audio content, and all other materials, is owned by Yavuz Akbay and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8.2 Islamic Content

Quranic text, translations, and audio recitations included in the App are sourced from public domain or appropriately licensed sources. These materials are provided for personal religious use only.

8.3 Restrictions

You may not copy, modify, distribute, sell, or sublicense any part of the App without our express written permission.

9. Third-Party Services

The App integrates with third-party services including Firebase (Google LLC), Google Sign-In, Apple CloudKit, and Apple's App Store. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

10. Disclaimers

10.1 Religious Information

The App provides prayer time calculations, Qibla direction, Zakat estimates, and Islamic calendar information as a convenience tool. These calculations are based on widely accepted algorithms and methodologies, but:

• Prayer times may vary by a few minutes depending on local geography and the calculation method used
• Zakat calculations are estimates only and should be verified with a qualified Islamic scholar for significant amounts
• We do not provide religious rulings (fatwas) or legal religious advice

10.2 Location and Maps

Mosque and halal restaurant data is provided by third parties and may not be accurate or up to date. Always verify information independently.

10.3 App Availability

We do not guarantee that the App will be available at all times, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the App at any time with reasonable notice where possible.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Yavuz Akbay shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Damages arising from your use or inability to use the App
• Any errors or inaccuracies in prayer time calculations, Qibla direction, or Zakat estimates

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid for the App in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Yavuz Akbay and affiliates from and against any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your use of the Prayer Buddy or feedback features in violation of these Terms

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of this document
• Displaying a notice within the App

Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at support@ilmora.app. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Germany.

For users in the European Union: Nothing in these Terms limits your rights under EU consumer protection laws, including your right to bring disputes before the courts of your country of residence.

16. Apple-Specific Terms

As the App is distributed through Apple's App Store, the following additional terms apply:

• These Terms are between you and Yavuz Akbay only, not Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; Apple has no other warranty obligations
• Apple is not responsible for addressing any claims related to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yavuz Akbay with respect to the App and supersede all prior agreements.
